Defendant conspired and agreed with co-defendants to distribute, and possess with the intent to distribute controlled substances concealed in packages by delivering them through the United States Postal Service in Los Angeles County. The overall conspiracy resulted in the overdose death of one victim. The defendant faced a minimum mandatory sentence of 10 years in prison.
However, Mr. Khojayan was able to argue a safety valve reduction for his client was proper (avoiding the mandatory minimum sentence) because his count of conviction did not result in the death of anyone.
Further, per Mr. Khojayan’s advice the defendant worked on and obtained his GED before sentencing. His GED, plus his continued work as a truck driver and provider for his family, enabled Mr. Khojayan to argue that his client had completely rehabilitated and deserved a second chance. The judge then overruled the government’s requests for a 46 or even 24 months prison sentence and gave Mr. Khojayan’s client only probation with 9 months house arrest that allowed his client to continue working and avoid any jail time.
