LOS ANGELES, CALIFORNIA – The Los Angeles District Attorney’s Office has dismissed heroin distribution charges against Mr. Khojayan’s client due to illegal wiretap applications from the Riverside District Attorney’s Office. In August 2015, the defendant, a 20 year legal permanent resident, was charged in California Superior Court with heroin trafficking. The Los Angeles District Attorney demanded a prison sentence of at least 8 years from the defendant. Any drug trafficking conviction would also mean deportation. The charges were based on phone conversations recorded from illegal wiretap applications sought in Riverside. The wiretaps were illegal because the wrong official had approved the wiretap applications – only the District Attorney or a properly designated assistant district attorney could authorize the wiretaps. Mr. Khojayan refused all plea offers – knowing the wiretap evidence was illegal. Then, with the preliminary hearing fast approaching and the case unresolved, the district attorney agreed to dismiss the charges. No conviction meant that the defendant would not face any prison time and that he would not be deported from the United States. The defendant was very pleased with the outcome of the case.
